In Oklahoma, when a person is arrested for a DUI, the officer often files the report with the charge, “DUI 1st Offense” or “DUI 2nd Offense”. All this means is if you are charged with a DUI 1st Offense, it is a misdemeanor, and if you are charged with a DUI 2nd Offense, it is a felony.

A misdemeanor DUI in Oklahoma carries from 0-6 months in jail and up to a $1,000.00 fine if you are charged in a municipal court (typically Tulsa, OKC, or Norman), and if you are charged in any county court, a DUI carries up to one (1) year in the county jail and up to a $1,000.00 fine. This doesn’t even take into consideration your Oklahoma Driver’s License could be suspended and/or you could be forced to install an ignition interlock device in your vehicle. You only have so much time to request an administrative hearing to challenge the revocation of your DL.
